Disney Settles Class Action Lawsuit for Visually Impaired

Walt Disney Parks & Resorts and related Disney companies have reached a tentative agreement with a group that brought a class action lawsuit against the company and related companies. The agreement must be approved by a judge, and must also spend a short while others who may be covered by the settlement class.

The suit was originally brought on May 10, 2010, by a small group of visually impaired people who claimed that Disney was violating the Americans with Disabilities Act and California law by treating them discriminatorily as related to accessing the Disneyland theme parks and related online planning tools.

The original complaint was broken down into ten allegation classes, five of which were approved by the court to proceed. The tentative settlement agreement further condenses that to four settlement classes in order to cover all of the complaints in an efficient manner. The settlement classes remaining are the Website Class, the Effective Communication Class, the Service Animal Class, and the Infrastructure Class.

The Website Class relates to Disney's trip planning websites not being accessible to those utilizing screen readers. The Effective Communication Class claims that Disney has not made available the standard trip planning tools available to others, such as maps, menus, schedules, and information about sighted companions, among other items.

The Service Animal Class claims an inability to properly kennel their pets when riding attractions that the animals cannot, and that Disney characters actively avoid those with service animals. The Infrastructure Class notes that the plaintiffs are not able to take advantage of special parade viewing areas for the disabled, and do not have easy access to lockers in the park or parking lots at the Disneyland Resort.

The settlement includes a number of actions to be required of Disney:

For the Website Class – by December 31, 2012, Disney will have converted a majority of their content-related pages on the Walt Disney World website to be accessible to screen readers, including a page with an accessible version of the hours and schedules for the Walt Disney World parks otherwise posted on the site. All Walt Disney World menus currently posted on the site will also be accessible to screen readers.

By July 2013, Walt Disney World tickets, passes, rooms, and packages will be available for purchase by guests using screen readers. Disney will have converted a majority of their content-related pages on the Disneyland website to be accessible to screen readers, including a page with an accessible version of the hours and schedules for the Disneyland parks otherwise posted on the site. All Disneyland menus currently posted on the site will be accessible to screen readers.

By June 2014, Disneyland tickets, passes, rooms, and packages will be available for purchase by guests using screen readers.

By December 31, 2015, Disney Cruise Line passengers will be able to book staterooms, reserve online activities, and book shore excursions using screen readers. In addition, Disney will have converted a majority of their content-related pages on the Disney Cruise Line website to be accessible to screen readers. Certain sections of the websites are excluded. Disney further agrees to provide a telephone service to assist visually impaired guests until the websites are brought into compliance.

The Effective Communications Class – settlement includes Disney making available by telephone an audio recording that provides the schedules for major entertainment offerings (such as Fantasmic and World of Color) at the Disneyland Resort parks, parade and show information from the current park information sheets (and answer questions about such parades and shows), and within 90 days, to include the telephone number on the "services for guests with visual disabilities sheet available at the parks for both Disneyland and Walt Disney World resorts.

Those phone services will be included until either the Next Generation Handheld Device is deployed with the information on the schedule information sheet or the applicable portions of the park hours and schedule pages are available in screen-readable format for both Disneyland and Walt Disney World resorts.

Disney will also provide a telephone service to read information from menus for restaurants whose menus are posted on the park websites. The phone numbers will be added to the services pages on the Disneyland and Walt Disney World sites until either the Next Generation Handheld Device is deployed or the menus are available in a screen-readable format. Disney will also include menu information with the audio description service on the Next Gen handheld device.

Disney will also require cast members at food and beverage locations to read menus to guests on request and provide Braille menus at four restaurants. At least two stationary Braille maps will be provided at all domestic Disney parks, and mobile Braille maps will be available for a refundable deposit. Disney will provide, on a one-time basis, 100 one-day, one-park tickets each for the Disneyland Resort parks and the Walt Disney World parks to no more than two charitable organizations whose primary purpose is to serve individuals with visual impairments for use by companions of visually impaired guests.

The Service Animal Class – settlement provides for at least three service animal relief areas in the public areas at each of the domestic Disney parks and add that information to the relevant websites and information sheets. Disney will also provide temporary kennels or cages at attractions which the service animals cannot ride. It will also post a policy that guests can also do a rider swap with another member of their party who would watch the animal until the visually impaired guest returned from their ride.

Disney will also update its operating guidelines for all characters in the parks to ensure that their interaction with guests with service animals take place as if the guests do not have service animals.

The Infrastructure Class – settlement states that Disney will update operating guidelines to permit guests with visual impairments to utilize disabled parade viewing areas. Disney will also install five keyed lockers at a single location at both Disneyland and Disney California Adventure parks for use by guests with visual impairments. Disney will also provide an appropriate number of disabled parking spaces at the Pinocchio lot at the Disneyland Resort and make other relevant modifications.

The agreement also provides for Disney to pay service payments of up to $15,000 for each named plaintiff for their assistance in resolving the matter, and $1,550,000 in attorney fees.

The next step is for a judge of the U.S. District Court in the Central District of California, Western Division, to approve the settlement. Once it is approved, notices will be sent out to all potentially impacted individuals who can opt in or out of the class and support or attempt to block the settlement. Only after it gets past those steps would the settlement go into effect.

Cinco de Mayo at the Disneyland Resort

Cinco de Mayo commemorates the Mexican army's victory over France at the Battle of Puebla in 1862 during the Franco-Mexican War. The holiday is a relatively minor in Mexico, but has evolved in the United States into a celebration of Mexican culture and heritage.

To celebrate Cinco de Mayo, Tortilla Jo's in Downtown Disney is offering a number of specials, including a three-course prix fixe menu to augment their a la carte menu this Saturday, with items such as:

First Course Selections

  • Sopa de chorizo con papas – Creamy potato soup, leeks, chorizo, cilantro oil, crema fresca
  • Ensalada de berros – Watercress, orange bacon vinaigrette, fennel, tomatoes, oranges, Parmesan

Second Course Selections

  • Pescado estilo Veracruz – Pan-seared red snapper, green onion fingerling potatoes, Veracruz sauce
  • Tinga de carne – Chipotle slow-roasted shredded beef on a bed of lettuce, cotija cheese, lemon crema fresca, Fresno chile frijoles, tortilla ribbons

Dessert Selections

  • Panna cotta de Bandera – Custard served with three sauces: Strawberry and red wine, mint julip and lime, coconut milk crème anglaise

The prix fixe menu is $27 per person and does not include tax or gratuity.

Other specials at Tortilla Jo's include margarita specials, mariachi music in the evening, and piñatas at 3:00 p.m., 4:00 p.m., and 5:00 p.m. In addition, the restaurant is also scheduling a complimentary tequila tasting from 6:00 p.m. to 8:00 p.m.

Main Street prepares for a new window

In the March 26 update, we shared the news that Alice Davis would receive her own window on Main Street, USA. The ceremony is scheduled for the morning of Thursday, May 10. While no official announcement has been made about the location of the window, there is some compelling evidence that it will likely be above Disneyana, next to the window for her husband, Marc Davis.

Upon closer examination, the window to the right of Marc Davis' window is a not a window at all, but a flat piece of board painted to look like a window—complete with lace drapes.

Resort refurbishment and construction update

With a little over six weeks until Disney California Adventure park officially unveils Cars Land and Buena Vista Street, the weekly construction progress is less and less dramatic. What used to be noticeable changes is now down to the addition of very subtle, often unnoticeable, details.

  • AIDS Walk Orange County – Sunday May 6. The event takes place before park hours in Disneyland and Disney California Adventure. The Magic Morning normally scheduled for Sunday at Disneyland will likely be rescheduled to Monday, May 7, and Disneyland will likely open at 9 a.m. to accommodate the event. More information about the walk is available on the event website.
  • Grad Nite events – this party for high school seniors graduating in 2012 will be held May 11, 17, 18, 24, 25, 31 and June 1, 7, 8, 14. The 2012 event includes admission to Disneyland and Disney California Adventure during regular operating hours, and a private party in Disneyland after the park closes to the public for the night.
  • Celebrating 100 Years of Girl Scouting at Disneyland Resort – May 26 and 27.
  • Cars Land grand opening – Friday, June 15.
  • Destination D: 75 Years of Disney Animation – August 11 and 12. This D23 event returns to the Disneyland Resort in 2012. Additional details and registration information at www.Disney.com/D23.
  • 2012 Disneyland Half Marathon Weekend – August 31 – September 2. Event is now sold out.

Fall

  • CHOC Walk in the Park – Sunday October 14. Registration will open on May 15. The event takes place before park hours in Disneyland and Disney California Adventure.   • 2013 Tinker Bell Half Marathon Weekend – January 18–20. No additional details are available.
  • D23 Expo – August 9–11. Tickets for the three-day convention go on sale August 9, 2012.

We also recommend checking the convention calendar at the Anaheim/Orange County Visitor and Convention Bureau Web site (link). When looking at that site, remember to note both the number of people and the number of rooms resulting from each convention. A gathering of 25,000 people booking few room nights (indicating most will be driving in to the area for their meeting) can impact traffic around the Resort much more than a crowd of 25,000 staying in area hotels. Of course, that second group is going to make finding a hotel room more difficult (and possibly more expensive), so it's best to book your own room as early as possible if you see that a big convention is in town during your trip.

Current Discounts & Promotions

Several current promotions offer discounted admission to the Disneyland Resort. For your convenience, we have grouped the discount offers based on the number of days the tickets are valid. Check out the category that best matches the amount of time you plan to spend at the resort, and pick the offer that works best for you. And keep those tips coming—let us know if you find a better or different offer, so we can share it with other readers!

This first section is a list of discounts on ticket–only purchases. Though it has become more common in recent years, Disneyland tickets are rarely offered at deep discounts unless you are a resident of Southern California or Northern Mexico. For residents outside that area, the best discounts available tend to be simple advance purchase discounts.

One Day, One Park Ticket – Regularly $80/$74

One Day Park Hopper – Regularly $105/$99

Two Day, One Park per Day Ticket – Regularly $158/$146

SoCal Resident 2–Day 1–Park per Day ticket ($99)
SoCal Resident 2–Day Park Hopper ticket ($114)

The SoCal Resident 2–Day 1–Park per Day ticket offers residents of Southern California and Northern Baja California admission to either Disneyland or Disney California Adventure on one day, and then a second visit to either park on another day on or before June 8, 2012.

You can use both days of this ticket at the same theme park, or visit one park one day and the other park on the second day, but you can not use it to enter both parks on the same day. The ticket is $99 for ages 3 and up. You can also upgrade the ticket to a park–hopper, which allows entry to both parks each day, for an additional $15, a savings of up to $59 compared to the box office price of a two–day park–hopper ticket.

You can either purchase tickets at the Disneyland Resort ticket booths, or online at Disneyland.com and print them at home. You can also purchase them at participating Disney Stores and authorized third party ticket outlets, including many local grocery stores. There is no "fuse" on this ticket, which means you can use the first admission today and wait until June to use the second admission. You must, however, purchase the ticket by June 1, 2012. Tickets expires June 8, 2012, and are blocked out March 30–April 15, and June 4 and 5, 2012.

While Disney states that proof of residency required for purchase and admission, MousePlanet readers who have purchased similar tickets from off–property retailers during past resident discount promotions consistently reported that they were not required to provide proof of residency at the time of purchase. However, be aware that Disneyland Resort Main Gate cast members can–and may–require proof of residency when you first use the tickets. Whether the residency checks occur is an oft–debated topic on our MousePad discussion boards, but it is your responsibility to know the official policy, regardless of what the park's actual practice may be.

Now for the official fine print:

• TICKET IS BLOCKED OUT March 30, 2012 – April 15, 2012 and June 4, 2012 – June 5, 2012.
• Tickets valid only for Southern California residents within ZIP codes 90000–93599 and Northern Baja California residents within ZIP codes 21000–22999 and proof of residency is required for admission.

Promotional 3–Day Park Hopper Bonus Ticket ($199/$183) – A discounted price offered with advance purchase through the Disneyland Web site (link). This discount is not available at the theme park ticket booths, you must purchase online before you arrive. Tickets are valid January 4 to May 28, 2012. Disney is offering eTicket and Will Call service for this promotion, so you can purchase the tickets online the same day you plan to use them. Tickets must be purchased by, and first day of use must occur on or before, May 28, 2012. Tickets expire 13 days after the first day of use or on June 10, 2012, whichever occurs first. Tickets are blocked out March 30, 2012 to April 15, 2012.

Advance Purchase 3–day, One Park Per Day Bonus Ticket ($199/$183) or 3–day Park Hopper Bonus Ticket ($214/$198) – A discounted price for advance purchase through the Internet or select dealers. First use must be on or before December 31, 2012. These tickets have a 13–day "fuse," which means you must use all three admissions within 13 days of the first use, or forfeit the unused days. Disney Military Promotional 3–Day Park Hopper Ticket ($95) – A discounted price offered to active or retired U.S. military personnel or their spouses. Based on past offers, Disney defines "Eligible Service Members" as active or retired members of the US military, including active members of the National Guard or Reservists and active or retired members of the US Coast Guard. This discount is available at MWR/ITT offices at your military base, or at the Disneyland Resort ticket booths. Valid military ID is required. The price is the same for adults and children, and total of six tickets may be purchased per military member, regardless of who purchases the tickets (the member or their spouse). Tickets must be purchased by Sept 30, 2012. The ticket has the following blockout dates: December 24, 2011 to January 2, 2012; February 17 to 19, 2012; April 2 to 14, 2012; July 4, 2012.

As far as we can tell, there is no "fuse" on this ticket, so you may have more than the standard 13 days from first use to use the remaining two admissions, but we highly recommend you contact your base MWR/ITT office for more details before making travel plans. Please note that this ticket is not a "bonus" ticket, and so does not include an early admission day.

Southern California CityPass ($279/$239) – This pass includes a 3–Day Disneyland Resort Park Hopper Bonus Ticket (including one early–entry day), a one–day admission to either San Diego Zoo or San Diego Wild Animal Park, as well as one–day admission to Sea World San Diego and Universal Studios Hollywood. The CityPass expires 14 days after first use at any location, and the first use must occur by January 3, 2011. Purchase CityPass through the Disneyland Website or on–site at the ticket booths of Disneyland Resort or the other theme parks included in the pass.     Landry's Select Club – Members of the Landry's Select Club get priority seating at the Rainforest Cafe when available (which makes a huge difference on busy days), and a 10% discount on retail purchases. This club replaces the former Rainforest Cafe Safari Club as of March 31, 2012. If you are already a Safari Club member, you can migrate your membership to the new Landry's Select Club at no charge, and start to earn points in the new program. All Safari Club points and benefits expire on March 31, so if you have any gift certificates left to redeem, you have just a week to do so. The new Select Club eliminated the entree discount and free appetizer offer that was included with the Safari Club, replacing them with a point–based system that gives you a $25 gift certificate after you spend $250. If you are not yet a member of either the Safari Club or the Landry's Select Club, you can pre–purchase your membership before your trip. Membership now costs $25, but comes with a $25 reward.

    ESPNZone MVP Club – Membership in the MVP Club does not offer any discounts on food. However, once a member you can make an online reservation for your party up to three days in advance and will get a 25% increase in points purchased when playing games in the Sports Arena (and 40 bonus points at activation). You must register online and your membership card will then be mailed to you within two weeks. The card must then be activated at any ESPNZone by the person who signed up for the card and ID will be required (link).

      So Disney will be required to put kennels or cages for dogs inside the park? I can hardly wait for the first parent who puts their kid in there to wait while they ride the attraction

      A minor correction to the update:

      ...Although it is still a month or so away from opening, the Lego store in Downtown Disney unveiled some of the new exterior decorations this week.

      According to the employee at the Lego Store a week or so when we were there, the remodeled Lego Store should open in early May. It's official grand opening is Memorial weekend and stores typically open a few weeks before their "grand opening" to work out any unexpected kinks. Of course, this store doesn't need to train new employees like a totally new store, so they don't need quite as much time before actual and grand openings. According to their May Calendar:

      Join up for the Grand Re-Opening celebration of the LEGO store at Disneyland Resort and help a LEGO Master Building construct an 8-ft tall LEGO Brickley model! Plus, visit the newly renovated store with brand new models on display for special offers available that weekend only. Visit stores.LEGO.com for more details. The LEGO Store at Disneyland Resort Anaheim, CA May 25-27.



      Despite referring you to their website, there is no additional information there (yet). They will probably post the May calendar online as early as tomorrow. Where there will actually be more details that what is listed in their calendar is unlikely.
